Apex Visa Service, hereafter known as "AVS", guarantees the approval of your petitions filed as long as you have followed AVS instructions, including supporting documents as instructed, have the forms signed per balloon instructions on the forms that AVS returned to client / petitioner, hereafter known as "you" or "your", assembled the petition package per assembly instructions and have otherwise followed AVS instructions or met AVS site advice on building a documented relationship and financial requirements for the eventual visa interview.
AVS guarantees the visa be granted as long as you have followed AVS written instructions and neither of the two of you (you and visa beneficiary) have hidden any information from AVS, the U.S. Consulate, each other of you or have . You render AVS harmless in the event the U.S. Government departments involved in the visa process changes laws or procedures during the process that begins with AVS starting your case.
Credit shall be allowed in K1 visa services if the foreign beneficiary has not met the courtship building requirements. However, refiling a K1 petition is limited to once every 2 years by law. If a petition fails because of the courtship proof, the petitioner may not petition for a K1 beneficiary again for 2 years. The credit is allowed if the petitioner files for the same person again, and the foreign beneficiary still lives in the same country when petitioned for the first time.
You stipulate by placing an order by yourself or agent with AVS, that any advice given you by any other source shall be be taken as a conflict with AVS advice unless specifically agreed to by AVS, and will result in termination of Service by AVS.
Further, you stipulate that no employee of AVS may extend Service credit or refund beyond 1 year of service order once a service has begun, and, stipulate that any violation by the U.S. Government shall not be held against AVS as failure to comply; perform; or otherwise failure in AVS's duty to you. AVS may not be accountable for U.S. Government failure in their duties under the law and/or legal protection of the U.S. Constitution. Any conflict of law, or actions of the U.S. Government in administrating the laws, are considered unresolved, and until resolved, you stipulate that AVS not be held accountable nor have a duty to "fix", "refund", "credit" or otherwise "correct" such conflict.
Intellectual property : All information or instructions given to you either on paper or electronically shall be considered Intellectual Property and as such, may be retained in your memory and may not be returned. Once sent electronically, it is considered retained by you and not returnable or refundable,. The "sent" copy of said information shall be deemed delivered by AVS and must be used within 1 year. Should you not find it, you may request AVS to send it again as a matter of assistance to/for you.
Refunds are determined upon failure by AVS to perform in it's duty to you upon proof of failure within the bounds of this document. In order to give you, the recipient client, full control of your case, AVS details for you, how your case must be filed, thus giving you control of the documents and forms, and requiring the U.S. Government to give you the recipient client, first notice of any action or notice by the U.S. Government, so that it cannot be lost or otherwise buried or delayed by AVS. You further stipulate that any legal action remain in the legal jurisdiction of the State of Minnesota.
Arbitration outside a court of law shall be accomplished by your bank of payment, agency for credit card, or the Better Business Bureau.
In executing the act of procuring AVS service, you agree to these terms. In accepting your order, AVS agrees to these terms and those specifically stated on the AVS web site and good practices of the Better Business Bureau of North Dakota / Minnesota.
This document shall supercede any email, facsimile, or phone agreements as this is publicly witnessed, whereas private communication is not, and carries no legal covenant.
